Art. no. 1 Definitions

In these Terms and Conditions (hereafter: conditions) shall apply:

1.1 Customer:
Any natural or legal person who contact CushionandPillow.com about the conclusion of an agreement.

1.2. Agreement:
Any agreement between the buyer and CushionandPillow.com reached, any amendment or supplement thereto, and all legal actions for the preparation and implementation of that agreement.

1.3. Products:
Cushions, pillows, placemats
Sierkussens, placemats, table runners, plaids, seat cushions etc.

1.4 Services:
The services of CushionandPillow.com, by whether or not related to products, to be provided including service delivery in the broadest sense.

1.5 Order:
Any order from the customer to CushionandPillow.com. Orders can only be placed via the CushionandPillow.com online store.


Art. no. 2. General conditions

2.1. By placing an order through the internet shop of CushionandPillow.com, the customer indicates that he agrees with the general conditions. CushionandPillow.com has the right to change its terms and the its contents.

2.2. CushionandPillow.com ensures that the order is executed upon receipt of payment to CushionandPillow.com. The ordered products are delivered to the customer with shipping costs behalf of the customer and the risk of transport to CushionandPillow.com.

2.3. All products are delivered to your door.

2.4. CushionandPillow.com is authorised to use third party services to execute a customer's order.

2.5. CushionandPillow.com is allowed to deny access to the webshop to any customer, without giving reason.


Art. no. 3. Offers / Agreements

3.1. All offers are without obligation and CushionandPillow.com reserves the right to change prices, especially when under (legal) regulations.

3.2.  A contract is only concluded after the customer supplied all information requested by CushionandPillow.com and CushionandPillow.com has confirmed the order to the e-mailaddress specified by the customer. The customer must report any inaccuracies in the order confirmation immediately upon receipt to CushionandPillow.com.

3.3. CushionandPillow.com is entitled to refuse orders or apply special conditions to the delivery, unless otherwise specified. If an order is not accepted, CushionandPillow.com will notify customer within ten (10) days after receipt of order.


Art. no. 4. Prices and payments

4.1 . The prices for the products and services are in Euros and include tax (VAT). Purchase price and additional costs for tax and shipping charges are clearly stated in the order confirmation and invoice.

4.2. All prices on this site are subject to misprints. For the consequences of misprints no liability is accepted.

4.3. Payment of an online order goes through: iDEAL, bank transfer or via PayPal. More payment conditions can be applied to your. When paying by bank or giro, the date of payment is the date of crediting to the bank account of CushionandPillow.com

4.4. CushionandPillow.com reserves the right not to offer one or more of the above payment options, for a fixed period.

4.5. Customer may cancel an order or terminate the agreement in accordance with the statutory law concerning online shopping.


Art. no. 5. Delivery

5.1. Delivery dates communicated by CushionandPillow.com are indicative only. Customer is not entitled the right of compensation or the right to cancel the order when delivery times exceed the indicated period.
When a delay in delivery occurs, customer will be notified by e-mail or telephone about the expected delivery time.

5.2. CushionandPillow.com ships orders using the services of DPD.

As soon as payment is received, CushionandPillow.com will process the order. Upon receipt of your payment, your order will be shipped as soon as possible.

The timing of delivery is Monday / Friday from 8.30-18.00 hrs. If the buyer is not present then they will receive a written notice. The order will be offered again the next business day by DPD.

5.3. CushionandPillow.com sends its products to various European countries.

Art. no. 6. Delivery and risk

CushionandPillow.com is in no way responsible for misunderstandings, damages, delays or unclear orders and communications caused by the Internet or any other communication traffic between CushionandPillow.com and the customer. The colors of the products that are displayed in the online shop may differ from the actual product colors. CushionandPillow.com takes full responsibility of shipping, however, the costs will be charged to the customer.

Art. no. 7. Shipping costs

All orders are delivered to an address in one of the countries CushionandPillow.com ships to, provided by the customer. There is a fixed price including VAT for shipping.
For orders over 30, - Euro including VAT, there are no shipping costs (not in all countries). For orders under 30, - Euro including VAT, the shipping costs are 7,50 Euros (not in all countries).


Art. no. 8. Deliveries and guarantees

CushionandPillow.com ensures that each product delivered meets the normal requirements of reliability and usability. For the delivered products, guarantee applies as determined by the manufacturers.

There can be no question of a guarantee if the normal wear and can be considered further in the following cases:
There is no refund or other compensation for normal wear of products and in the following cases:

- If there are changes made to the product, including repairs not authorized by CushionandPillow.com.
- If the original packing slip can not be submitted, is changed or defaced.
- If damage is caused by intent, gross negligence or improper maintenance.

Art. no. 8.1. Exchange and return:

If the customer believes that supplies do not meet the agreement, the customner has the choice to return the products to be replaced by a new delivery, within fourteen (14) days after delivery of the order. The customer must notify CushionandPillow.com before returning any products. Shipping costs for return order are for account of customer.

If the customer does not want an item, only the cost of the item itself will be refunded to the buyer, the shipping and / or collection costs are borne by the customer.

Should the customer wish to exchange an item for another item or another size, a new bill be made and also a new calculation. Any balance will be refunded to the customer.

Art. no. 8.2. Defective and/or incomplete shipments:

The risk of loss or damage of goods being the subject of the contract shall pass to the buyer at the time the goods are offered for delivery at the specified address specified. In the case of defects, the customer must notify CushionandPillow.com immediately upon receipt of the goods. Shipping costs for returning defective products are borne by CushionandPillow.


Art. no. 9. Ownership

The ownership of products is transferred to the buyer only after all subject to the agreement has been paid. The risk in respect of the products transfers to the customer at the time of delivery.


Art. no. 10. Force Majeure

10.1. Notwithstanding other rights, CushionandPillow.com in case of force majeure has the right, at its option, to suspend the execution of your order or terminate the contract without judicial intervention, by notifying the customer in writing and without being liable for any damages, unless under the circumstances to standards of reasonableness and fairness.

10.2.  Force majeure means any failure to CushionandPillow.com can be attributed, because he is not due to his fault and not under the law, legal act or generally accepted for its account. Force majeure shall mean any Sierkussen.nl's circumstance beyond which the fulfillment of its obligations to the purchaser fully or partially prevented. Those circumstances include strikes, fires, business disturbances, power failures, failures in (telecommunications) networks or connections or communications and / or at any time not available from the web site, non or late delivery by suppliers or other third parties and the lack of any government issued license.

Art. no. 11. Miscellaneous

11.1. If the customer supplies CushionandPillow.com with an address, CushionandPillow.com is entitled to send orders to that address, unless the customer notifies CushionandPillow.com orders should be sent to an other address.

11.2. When CushionandPillow.com, during any period of time, whether or not deviates from these Conditions, does not affect its right to demand immediate and strict compliance with these Conditions. The customer may never be entitled to apply on the grounds that CushionandPillow.com these conditions smoothly.

11.3. If one or more provisions of these conditions or any other agreement with CushionandPillow.com are in conflict with any applicable law, the provision will lapse and will be replaced by a new one to determine CushionandPillow.com admissible similar provision.

11.4. CushionandPillow.com is authorized to use third party services for the execution of the order (s) of the customer.

11.5. CushionandPillow.com handles the details of the customer in conformity with its privacy policy. The website contains a Privacy Statement. CushionandPillow.com will observe the applicable laws and regulations are observed.


Art. no. 12. Applicable law and competent court

12.1. All rights, obligations, offers, orders and agreements to which these Conditions apply, including these conditions, only Dutch law applies.

12.2. All disputes between the parties shall be submitted to the competent court.
